The terms “the studio pec”, “the studio”, “studio”, “we” and “our” in this document refer to 1000250416 ONTARIO INC. and its employees, contractors, shareholders, officers, directors and agents. “You”, and “participants” will refer to you. All Retreats are offered subject to the studio’s standard terms and conditions. Please review the terms and conditions carefully prior to completing your reservation. Some of these terms and conditions are set out below to draw your attention to the fact that our obligations to you are limited. Should you have any questions or concerns please contact us.
PRICES, RESERVATIONS AND PAYMENT:
To reserve your studio Retreat, we require a deposit of CAD $1,017 ($900 +HST) per person. Your deposit is non-refundable and cannot be transferred to another Retreat. The balance of your payment is due 100 days prior to departure on December 13, 2024. If reserving your trip within 100 days of departure, full payment is required. To complete your reservation, you must sign a Retreat Participation Form and an Acknowledgement of Risk, Release and Indemnity, prior to your date of travel with us. These will be sent to you shortly after your deposit has been processed. These forms include additional terms and conditions of travel, including limitations of our obligations to you.

ELIGIBILITY
We require that travellers be at least 18 years of age (at time of travel) on all Retreats.
PREPARING FOR YOUR TRIP
Our Retreats entail risks—and rewards—beyond those encountered at home. We count on participants to ensure they are in good health; to read our pre-trip materials about packing; and to appreciate that in some countries local living standards, practices, services and accommodations may differ from those to which you are accustomed.
TRAVEL DOCUMENTS
Travel documents, which may include, but are not limited to, visas, passports, proof of vaccination, proof of COVID-19 testing, proof of medical insurance, and any other government-mandated documentation required by countries to which we travel may vary according to the nationality of each participant and may change at any time for reasons beyond our control. Although we endeavour to provide you with accurate information about these requirements it remains your responsibility to verify that you have the appropriate travel documents related to this trip for your nationality. The studio pec is not liable for any expenses or costs arising from any traveller being prohibited from entering a country scheduled to be visited on a trip.

→ Transportation to and from the retreat centre
→ Travel insurance
→ Alcohol ** there is no alcohol permitted at the retreat centre
EXTERNAL TRAVEL SERVICES
The studio pec may recommend the services of external travel companies or other support services in response to requests made by participants for services outside of the scope of a studio Retreat. Although we endeavour to recommend only companies that provide the highest levels of service and work closely with them, we do not guarantee the services provided by third parties. The studio pec is not liable for any injury, expenses, costs or cancellation penalties arising from any services, or lack thereof, provided by any third party nor the standards of care which participant experience when using those services.
HEALTH
By sending a deposit toward your Retreat purchase and completing your Retreat Participation Form, you certify that you do not have any physical or mental condition that would create a hazard for you or other travellers and that you have received all appropriate or necessary vaccinations as required by your country(ies) of destination. Please consult your doctor.
You acknowledge that should you choose not to advise us of any physical, mental or emotional condition, limitation or ability, or vaccination status, we may not be able to fully accommodate you on all aspects and features of a trip.
Each participant shall be responsible for carrying and providing to local authorities and service providers proof of vaccination, proof of COVID-19 testing, proof of medical insurance and all other government-mandated forms as required by local authorities in the country(ies) of destination. It is your responsibility to be aware of and to comply with all such requirements and laws. The rules may change quickly and often – continue to inform yourself right up to and during your trip.
INSURANCE
Before travelling on a Retreat, we strongly recommend you review your personal insurance and health insurance to ensure you have coverage appropriate to meet your needs, and the needs of your family and dependants, in case of any loss of property or illness, injury or death.
RISKS
Retreats may involve physical activity that can be demanding, depending on the condition of the traveller, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated.
Risks related to travel also include the likely presence of the virus that causes COVID-19, including variants (collectively “COVID-19”). Rates of COVID-19 infection may be higher, and rates of vaccination may be lower at the locations of your Retreat than in your home state or country, and that the sophistication and availability of therapies, medical practitioners and hospital beds for treatment of COVID-19 may be significantly impaired. Laws, regulations, customs and policies related to COVID-19 in the destinations and premises where you will travel on Retreat (“Local Regulations”) may be different than in your home country.
There are other risks associated with studio Retreats, such as theft or loss of or damage to property. Some of the services provided in connection with the Retreat, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom the studio pec has no control.
You, the participant, are aware that there are risks associated with participating in fitness activities and exercise. Your participation is completely voluntary, and you freely accept and fully assume all responsibility for all risks, and all possibilities of personal injury, death, property damage or loss to yourself or any other person as a result of your participation in fitness activities. You and your heirs, next of kin, executors, administrators and assignees agree:
(a) to waive all claims, known or unknown, that you have or may have in the future against THE STUDIO PEC, including their owners, officers, directors, agents, employees, volunteers, business operators, independent contractors and site property owners or lessees (the organization);
(b) that THE STUDIO PEC is not liable or responsible for any damage to, loss or theft of your property;
(c) to release and forever discharge THE STUDIO PEC from all liability for any personal injury, death, property damage or loss resulting from your participation in fitness activities due to any cause, including but not limited to negligence (failure to use such care as a reasonably prudent and a careful person would use under similar circumstances), breach of any duty imposed by law, breach of contract or mistake in error of judgment of THE STUDIO PEC; and
(d) to be liable for and to hold harmless and indemnify THE STUDIO PEC from all actions, proceedings, claims, damages, costs demands, including court costs on a solicitor and own client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with your participation in fitness activities.
Risks of what we are doing together. You understand that participating in the classes, private training, and services that we offer at THE STUDIO PEC there are activities that have inherent risks, some of which are more obvious than others. These risks can result in serious harm and injuries that could change your quality of life and in very rare and extreme circumstances may even result in death. Risks of these activities include but are not limited to the following:
Risks of movement, Yoga, dance, fitness, exercise and mat Pilates Group Classes and Private Sessions: muscle pulls, tears, and strains; sprained or broken bones; injuries from falling such as bruising or cuts; dizziness; fainting; feeling tired; erratic behaviour by other students resulting in collision with other students and/or you.
Risks of pre and postpartum Yoga, dance, fitness, exercise and Pilates. This section of the document applies only to people who are pregnant, have recently become pregnant or think that they may be pregnant (together, “Pregnant”). Practicing Yoga, dance, fitness or Pilates exercises while Pregnant comes with its own risks that you should be aware of before participating. It is understood that all of the risks of practicing yoga, dance, fitness, and Pilates exercises outlined in section 2.1 and 2.2 above apply equally to practicing while pregnant. In addition to these risks, practicing yoga, dance, fitness or Pilates exercises while pregnant can result in failed pregnancy, birth defects and enhanced nausea.
You understand that THE STUDIO PEC offers a wide range of movement modalities and that any time you are moving your body there are certain cardiovascular and skeletomuscular risks. You agree to progress at your own pace and inform the instructor if at any time you feel unwell or unable to perform a movement safely.
Medical Advice. You acknowledge that you will consult with a physician prior to your participation in THE STUDIO PEC classes/privates or that you are certain that your medical and fitness levels are sufficient for you to participate. You acknowledge that your mental health and physical conditions will not prevent your full participation in dance, Yoga, fitness, Pilates and other THE STUDIO PEC Classes, Private Sessions, and Retreats and that you will disclose any serious medical conditions or injuries to the instructor prior to beginning a class in order to determine whether you can partake.
CANCELLING YOUR RETREAT
If you have to cancel your studio Retreat, you are entitled to the return of these amounts:
Cancellation by Traveller:
Your deposit is non-refundable. Your final payment will be processed 100 days prior to the Retreat on December 13, 2024.
· 100-61 days prior to departure: 25% refund of full Retreat cost less deposit
· 60-0 days prior to departure: 0% refund of full Retreat cost / 100% cancellation fee
CANCELLATION BY THE STUDIO PEC
The studio pec the right to cancel any scheduled Retreat at any time for any reason determined in our sole discretion. We require a minimum number of participants in order for the Retreat to run. If that minimum number is not met prior to the final payment day (100 days prior to departure) the Retreat is subject to cancellation and your deposit will be refunded. We recommend that you confirm with the studio that the retreat has reached minimum capacity before making your travel arrangements. Flights and/or additional accommodation costs and/or general travel expenses incurred by participants will NOT be reimbursed due to the cancellation of a Retreat by the studio pec prior to your final payment.
Cancellation by the studio pec after final payment
In the event that the studio pec determines to cancel a scheduled Retreat for reasons of force majeure (including acts of war, terrorism, civil unrest, quarantine, curfew, natural disaster, pandemic, epidemic and other causes outside of the studio’s control), or if the quality of the trip or the safety of the travellers is judged by the studio pec to be compromised by factors external to the studio, the studio pec will endeavour to refund payments made by participants. We ask that participants recognize that there are expenses - including unrecoverable third-party deposits - that the studio cannot recoup as the planned date of a Retreat approaches and as a result, a refund is not always possible. However, we will make every effort to recover, for the benefit of our participants, as many of those expenses as we are able. The studio is not responsible for any travel costs incurred by participants due to the cancellation of a Retreat after to your final payment.
THE STUDIO’S DISCRETION TO RUN SCHEDULED RETREATS
The studio pec retains the sole discretion to run any scheduled Retreat notwithstanding the occurrence of any event or the existence of any condition in or near any place of travel included on a trip itinerary or in proximity to such a place or affecting travel, including air travel, in general. If the studio determines in good faith to run a trip, then with respect to that trip, any participant cancelling a reservation shall be bound by the cancellation policies applicable to trips cancelled by the traveller in accordance with the provisions above.

CANCELLATION INSURANCE
We strongly recommend you purchase cancellation insurance to protect yourself from unexpected circumstances that may cause you to cancel your trip. Our recommended Travel Services partner will be able to offer you travel insurance. You are not required to purchase travel insurance from our preferred partner but we would recommend you secure a travel protection plan prior to your trip.
In particular, the impact of COVID-19 on travel means that elements of your Retreat are beyond the control of the studio pec – this may include border closures, government-mandated quarantines, etc. We will do our utmost to ensure your safety; however, the studio pec is not liable for any expenses, changes to the trip itinerary or medical emergencies. Any costs associated with cancellations or delays are your responsibility.
MEDIA RELEASE
You agree to grant us the irrevocable right and permission to use, throughout the world and in perpetuity, your image, likeness, photographs, video content, audio recordings or any other record of you that is submitted to us directly (via email, Facebook, Instagram or other messaging service) or posted on your social media account with THE STUDIO PEC or any other affiliated hashtags or that tags THE STUDIO PEC’s social media account, whether captured by you, us, or a third party, for any purpose whatsoever without asking you for permission. You also release us from all claims that you may have in relation to the use of your image and any posts made by you in the ways mentioned above. That was a bunch of legal language that gives us permission to use photos and videos of you that we take during our classes and training or that you post on your social media account that are related to your workouts or experiences with THE STUDIO PEC. For example, it gives us permission to repost photos of you that tag us.
